Almost daily we hear about the one meltdown after another of huge companies and corporations. They fall one by one almost every day. It becomes more and more distressing to hear about so many folks losing not only their homes but also their businesses all going down in the roaring foreclosure market. A frequent casuse of foreclosure is lack of income caused by the death of the main bread winner of the family. Followed closely in second place as the cause of foreclosure is the frequent separation or divorce of a family.
Tons and Tons of foreclosures in Virginia Beach were mainly created by unscruplous lenders, who routinely provided loans to folks who could not afford any sort of loan to begin with. In addition to that, a large number foreclosures have been caused by out and out fraud and misrepresentation. In some cases it has been shown that unscrupulous sellers and even real estate agents caused the problem by placing cash money into a buyers account to make it look as if they had sufficient savings, and later the misrepresenters withdraw these funds shortly following closing of the loan.
When a lender takes a property from the home owner due to failure of the borrower to make the required payments, it is called a foreclosure. The lending document determines the rate and amount of payment required by the buyer. Lord only knows we have more than our fair share of Virginia Beach foreclosures in our neighborhood.
In each state, the foreclosure law is significantly different and therefore each buyer is treated different in each state. However the result is the same in all state, we end up with a foreclosure. At this time the lender takes the property back from the defaulted buyer and makes an attempt to sell it for market value.
The official alert to all parties is done when the lis penden is filed in the city of Virginia Beach. All interested parties must be alerted that a foreclosure action is pending. After the lis penden is filed, it is very difficult to turn back. A home owner hopes he will never arrive at this no turning point.
Many times the homeowner will try to delay or avoid the foreclosure process by not answering any phone calls and failing to accept any of the certified mail that is sent to them. This is absoulutely the wrong thing to do, its more important that the defaulting buyer approach the lender with ideas as to how the problem may be solved. In many cases, the lender will bend over backwards to prevent the foreclosure. The lender does not want a successful foreclosure, since he will generally be an overall loser just like you. In some cases the payment may be restructured so that you could continue to make the payments and remain in the home. Try anything the lender is willing to go along with.
The sale will be in the form of an auction and the lender will set the price for the sale when the home goes up on the court house steps for bidding. Generally the first bid will be that of the lender who usually bids high enought to cover his losses. This bid will normally include the balance owed on the property including any over due payments and any property taxes that might be due on the property. Frequently, the bid from the lender is more than other bidders are willing to offer. When this happens, the property will revert to the lender and he will have to sell it directly himself. At this point a lender may turn the property over to a realtor for resale. If the realtor ends up selling the property for much less than you owe, it is possible that you will recieve a huge bill for the difference in what you owed and what the property sold for. In many cases, the bill is so large that you may have to file for bankruptcy.
